Is Form INC-29 still filed?

By CS Shweta Sharma Updated

Form INC-29 is not filed for a company being incorporated now. The application is SPICe+. Part A reserves the name. Part B files the memorandum, the articles, and the registered-office proof.

What is filed now?

SPICe+ is the incorporation application on the Ministry of Corporate Affairs portal. It covers the name, the incorporation, the director identification number for a person who does not already have one, and the permanent account number and tax-deduction number that the form allots with the company. The steps for a private limited company are on that service page. A fee is paid on the portal. This page does not quote that fee.

What did INC-29 combine?

Form INC-29 was an earlier single form for name, director number, and incorporation. It has been replaced. Filing it is not a faster route around SPICe+. A checklist written for INC-29, including a separate name approval before the incorporation form, is the old sequence.

Which company used it?

While it was open, the form was aimed at a new company, including a private company, a public company, and a one person company. That history does not keep the form open. A public company and a one person company are incorporated in SPICe+ as well.

Where do the memorandum and articles go?

They are filed in SPICe+ Part B, with the registered-office proof. A practising professional’s declaration that the requirements of the Act have been complied with goes with that application. Identity and address proofs of the subscribers and first directors go there too. They are not collected for a revived INC-29.

Frequently asked questions

Four questions cover a new filing, a director number, the name, and a public company.

Can a new company still file INC-29?

No. Incorporation is filed in SPICe+. Form INC-29 was an earlier integrated form. It is not the form on the portal for a company being incorporated now.

Does a director still file DIR-3 before SPICe+?

Not as a separate first step for a new company. SPICe+ allots the director identification number with the incorporation. DIR-3 is not the incorporation form.

Does INC-29 reserve a name in 2026?

No. The name is reserved in SPICe+ Part A. Part B files the incorporation, including the memorandum, the articles, and the registered-office proof.

Is a public company still on INC-29?

No. A private company, a public company, and a one person company are incorporated in SPICe+. The old form did not leave a separate route for a public company.
