Does one Shops Act apply in every state?

One Shops Act does not apply in every state. Each state has its own Shops and Establishments Act, administered by that state’s labour department. Hours, leave, weekly holidays, and registration follow that Act. Incorporating a company does not register the shop.

Which law applies?

The establishment is registered where it is situated. A shop in Rajasthan and a shop in Gujarat are not under one form, one fee, or one certificate period. The Act typically covers shops and commercial establishments such as offices, hotels, and places of amusement, and it leaves out what that state’s text leaves out. A factory under the Factories Act, 1948 is a different registration.

What does a state Act usually cover?

The usual subjects are opening and closing hours, daily and weekly limits on work, a rest interval, a weekly holiday, leave, the time of payment of wages, and the records the employer keeps. Employment of a child is restricted by the state Act and by the law on child labour. The exact hour and the exact leave are in the state’s rules. This page does not set a national hour or a national fine.

How is an establishment registered?

The occupier applies to the inspector under that state’s Act, online or at the office the state names, with the identity of the employer, the address, the nature of the establishment, and the number of people employed. The fee is the state’s fee. Some states issue a certificate that lasts for a fixed term and is renewed. Others treat the registration as continuing until it is closed or amended. The certificate is displayed at the establishment where the Act requires display.

Closing the establishment is notified to the inspector within the time that state’s Act gives. There is not one national period of fifteen days. A company that also needs a goods-and-services-tax registration, or a Registrar of Companies filing, does those under their own Acts. How a company is formed is on the private-company page. Is the registration filed with the Registrar of Companies?

No. It is a state labour registration, with the inspector under that state’s Act. Incorporating a company does not complete it.

Is the fee the same in every state?

No. The fee, the time for applying, and how long the certificate lasts are set by the state. This page does not quote a fee or a validity period.

Does the Factories Act replace it?

A factory covered by the Factories Act, 1948 is outside the shops law to the extent that state’s Act says so. A shop or an office is not a factory merely because people work there.

Is there one national day count for closing?

No. Many state Acts require the occupier to tell the inspector when the establishment closes. The number of days is in that Act, not in a single national rule.
