What does trademark class 25 cover?

By Akshay Biwal Updated

Trademark class 25 covers clothing, footwear, and headgear. Shirts, dresses, shoes, and hats sit in that class. A registration there protects the mark for those goods. It does not protect a handbag, a piece of jewellery, or the company that sells them.

What is in the class?

In class 25 Examples
Clothing Shirts, dresses, coats, and similar garments
Footwear Shoes, boots, and sandals
Headgear Hats and caps

The official list is the classification the Trade Marks Registry uses. This page does not reprint every item. If the goods are clothing, footwear, or headgear, class 25 is the class to check first.

What is a different class?

A handbag, a belt sold as a leather good, or jewellery is not brought into class 25 by being sold next to a shirt. Each of those has its own class. Filing only class 25 leaves those goods outside the registration. How an application is made is on the trademark page.

Does the class register the mark?

No. The applicant names the mark and the class. The Registrar examines it. An earlier similar mark in the same or a similar class can be raised under section 11. What that objection is, is on the objection page. The class number does not skip that examination, and this page does not quote a fee.

Frequently asked questions

Four questions cover handbags, incorporation, examination, and one class for every product.

Does class 25 cover a handbag?

No. Handbags are not clothing, footwear, or headgear. They are applied for in their own class. A registration in class 25 does not reach them.

Does the class incorporate the business?

No. A trademark is a brand in the classes named in the application. The company, if there is one, is incorporated separately.

Is the mark accepted because the class is right?

No. The Registrar examines the mark, including whether it conflicts with an earlier mark in the same or a similar class. The class number does not decide that.

Is one class enough for every product?

Only if every product sits in that class. Clothing and shoes can share class 25. A different product needs its own class.
